Terms of use.

1. Who you are agreeing with

These terms govern your use of the Idea Magic Box apps for iPhone and Mac, the Magic Sync service, and this website. The provider is the person named in the Impressum (“we”, “us”). By installing or using the app you accept these terms; if you do not accept them, don't install it.

2. The beta

Until general release, Idea Magic Box is pre-release software provided for testing. That means it may contain defects, change without notice, lose a feature you liked, or stop working. Builds are issued through Apple TestFlight (iPhone) and as a notarized direct download (Mac).

We can end the beta programme, or your participation in it, at any time. Nothing you do in the beta obliges you to buy anything later, and nothing here promises what a later version will cost.

Keep your own backups. The app writes plain files in a folder you control, so an ordinary backup of that folder is a complete backup of your ideas. Do that. Beta software is exactly the wrong thing to trust with the only copy of anything.

3. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own purposes, private or commercial. You may not resell, rent, sublicense, redistribute, or hand the beta builds to people outside the programme; you may not reverse-engineer the app except where the law says you may.

4. Your content stays yours

Every idea, recording, file and attachment you create remains yours. We claim no ownership, no licence and no right to use it. We do not read it, mine it, or train anything on it. The app stores it as plain markdown and ordinary media files in a folder you chose, so you can walk away with all of it at any moment, using nothing but the Finder.

You are responsible for what you capture and for having the right to capture it — including, where the law requires it, the consent of anyone you record.

5. Magic Sync

Sync is optional, off by default, and enabled per box. It is end-to-end encrypted: your content is encrypted on your device before upload and the server stores it only as ciphertext. What the server can and cannot see is listed in the privacy policy.

Consequences you should understand before switching it on:

• We cannot recover your data if you lose your password and your recovery key. Not “we would rather not” — we hold no key that can decrypt it. Store the recovery key somewhere safe.
• Sync is a convenience, not a backup service. It propagates your changes, including deletions.
• We may set reasonable limits on storage and request volume, and suspend an account that is being used to attack or overload the service.
• Sync is free during the beta. We have not set terms for what happens after it, and nothing on this site is an offer or a price. You will be told before anything changes, and you can always turn sync off and keep using the app fully offline.

6. Acceptable use

Don't use the service to store or distribute unlawful material, to break into it, to probe or overload it, or to circumvent its limits. We may suspend or terminate an account that does — noting that because the contents are encrypted, we act on service behaviour, not on what is inside your boxes, which we cannot see.

7. Third parties

• Apple. If you got the app from the App Store or TestFlight, Apple's own terms apply to that distribution — during the beta, the TestFlight terms; for App Store downloads, Apple's Licensed Application End User License Agreement, which these terms supplement. Apple is not a party to these terms and has no obligation to support the app.
• Cloudflare hosts this site and the sync service as our processor.
• Hugging Face hosts the transcription and AI models, when you choose to download one.

8. Availability and changes

We do not promise that the app or the sync service will be available without interruption or free of defects. We may change, suspend or discontinue features, and we may update these terms — if a change matters, we will say so by email to beta participants and update the date on this page. Continuing to use the app after a change means you accept it.

9. Warranty and liability

The beta software is provided as is, without warranty, to the extent the law allows. Nothing here limits liability for injury to life, body or health, for intent or gross negligence, for fraudulently concealed defects, or under the German Product Liability Act (Produkthaftungsgesetz).

For slight negligence we are liable only for breach of an obligation whose fulfilment makes performance of the contract possible in the first place and on which you may reasonably rely (a Kardinalpflicht), and then only for foreseeable damage typical of this kind of contract. Your statutory rights as a consumer are unaffected.

10. Termination

You can stop at any time: delete the app, and delete your sync account from Settings if you made one. Your files stay on your disk. We may terminate access for a material breach of these terms, or when the beta programme ends.

11. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, you also keep the protection of the mandatory rules of your country of residence. If any provision here is invalid, the rest stays in force.
